“Care Experience should be a protected characteristic”, writes ShowUsYouCareToo campaigning group to Care Review in open letter

Today, a group of care experienced individuals have come together under the campaigning name ‘ShowUsYouCareToo’ to ask the Independent Review for Children’s Social Care, headed by Josh MacAlister, to recommend that care experience becomes a protected characteristic in law. The group are appealing to care experienced people alongside the general public to co-sign their open letter.  

If care experience was a protected characteristic, government and public bodies would have a strengthened legal duty to uphold the rights of 100,000 care leavers up to the age of 25 in England, and over 80,000 children currently in care, as well as an estimated one million care-experienced people across the UK.

One impact of the change sought would be that public bodies, including councils, the NHS and Police, would be required by law to consider how their policies and practices affect care experienced people and take steps to remove disadvantages they face. Decision-makers would have an obligation to consider the needs of care experienced people, without the community having to ask, explain or plead. 

The group says that the cliff-edge in support that care-leavers face would be minimised, as every person who has at any stage of their life, or for any length of time, been in care would be recognised as care experienced and entitled to additional support and consideration. 

"We are aiming to bring people from this community together behind a single campaign that unites us. We are all individuals, and we don’t represent anyone but ourselves, we are loud and proud, but unfortunately many in this community are oppressed and don’t have voice. A protected characteristic will create systemic change and will give voice to those most in need. It is important that the Care Review listen to what we are saying, as if it really wants to create systemic change then it must be bold and make this a firm recommendation."

The campaign is being supported the Together Trust, a charity established in 1870 that provides services to care experienced people, as well as people with disabilities, autism and mental health needs. 

"Jakeb, a passionate individual and care-experienced campaigner, told us last year that he believed that the best way to create change and end discrimination was for care experience to be recognised as a protected characteristic in law. Sadly, he has since passed away. We want to see this symbolic change in law for Jakeb, for the people we support and have supported, and for all care experienced people across the UK."

"I lived in foster care and faced daily discrimination where I was treated differently from their own children, it hurt and made me feel worthless which then impacted me as I left care. I found it difficult to get into work and settle. I believe in the care experienced community and what they have to uniquely offer society. I am working to develop societies' understanding about the support that the care experienced community needs to succeed and become a valued social group. Achieving this is in the best interests of both care-experienced people and wider society in general. It will serve to create a more inclusive and equal environment for the care experienced community to thrive in."

It is evident that care experienced people encounter all kinds of prejudice and discrimination. The protected characteristic will provide the foundation for every part of our society to fully support and champion care experienced people. By being recognised as having a protected characteristic, care experienced people can expect equal opportunities, fairer treatment and a much brighter future.
